Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PsychDraft application and related services (the “Service”) operated by PsychDraft, Inc. (“PsychDraft,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Eligibility
PsychDraft is intended for use only by licensed mental health professionals or trainees operating under appropriate supervision. By using the Service, you represent and warrant that you meet these requirements.
The Service is not intended for use by individuals under 18 years of age.
2. Nature of the Service
PsychDraft is an AI-assisted drafting support tool designed to help clinicians generate structured report language.
PsychDraft:
- Is not a medical device
- Does not provide medical advice
- Does not diagnose or treat any condition
- Does not replace professional clinical judgment
All content generated through the Service must be reviewed, edited, and verified by you prior to clinical use.
You are solely responsible for the final clinical content and any decisions made based on it.
3. Clinical Responsibility & PHI
You agree that:
- You remain fully responsible for compliance with HIPAA and all applicable privacy laws.
- You will not input Protected Health Information (PHI) unless a Business Associate Agreement (BAA) is in place or applicable law permits such use.
- You will use de-identified data whenever possible.
- PsychDraft acts solely as a drafting assistance tool and does not assume responsibility for regulatory compliance.
4. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately of any unauthorized access.
5. Subscription & Billing
PsychDraft operates on a subscription basis.
By subscribing, you agree:
- To pay all applicable fees associated with your selected plan.
- That payments are processed securely through third-party payment processors (e.g., Stripe).
- That subscriptions renew automatically unless canceled prior to the renewal date.
You may cancel your subscription at any time through your account settings or billing portal. Cancellation will apply at the end of the current billing period.
Unless required by law, subscription fees are non-refundable.
6. Intellectual Property
The Service, including its software, design, and original content (excluding content you input), is the exclusive property of PsychDraft, Inc.
You retain ownership of all content you provide or generate using the Service.
You may not copy, reverse engineer, distribute, or create derivative works of the Service without written permission.
7. AI & Output Disclaimer
You acknowledge that AI-generated content may contain inaccuracies, omissions, or unintended phrasing.
PsychDraft makes no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.
You are solely responsible for reviewing and approving all output before use.
8. Termination
We may suspend or terminate your access to the Service at our discretion if you violate these Terms or misuse the platform.
You may terminate your account at any time.
9. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied.
We disclaim all warranties, including but not limited to:
- Fitness for a particular purpose
- Merchantability
- Non-infringement
- Accuracy or reliability
10. Limitation of Liability
To the maximum extent permitted by law, PsychDraft, Inc., and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.
In no event shall our total liability exceed the amount paid by you to PsychDraft in the preceding twelve (12) months.
11. Indemnification
You agree to indemnify and hold harmless PsychDraft, Inc. from any claims, liabilities, damages, losses, and expenses arising out of:
- Your use of the Service
- Your clinical decisions
- Your violation of these Terms
- Your violation of applicable laws or regulations
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which PsychDraft, Inc. is incorporated, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the revised Terms.
